0. Effective Date, Jurisdiction, and Governing Law
These Terms of Service are effective as of June 2, 2026. Great Awareness is provided by Magna Conscius, operating in Kenya. These Terms are governed by the laws of Kenya. You irrevocably submit to the exclusive jurisdiction of the courts of Kenya for any disputes. By accessing or using Great Awareness, you accept these terms and agree to be bound by Kenya law.
1. Acceptance and Eligibility
By accessing, downloading, or using Great Awareness, you accept these Terms and agree to be bound by them. If you do not agree, do not use the platform. Great Awareness is intended for users aged 13 and above. Users under 18 may use Great Awareness only with parental or guardian consent. By using Great Awareness, you represent that you meet the age requirements and have the legal capacity to enter into this agreement.
2. User Accounts and Security
You are responsible for maintaining the confidentiality of your account credentials and password. You are solely responsible for all activity that occurs on your account. You agree to notify us immediately of any unauthorized access or use of your account. We reserve the right to refuse service, terminate accounts, or cancel orders at our sole discretion, particularly for violations of these Terms. You may not share your account with others or use another person's account. Account termination is final, and we are not liable for loss of data upon termination.
3. Intellectual Property Rights
Great Awareness, including all content, software, design, graphics, text, and features, is owned by Magna Conscius and protected by copyright and intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use Great Awareness for personal, non-commercial purposes only. You may not copy, modify, distribute, sell, lease, or reverse-engineer any aspect of Great Awareness.
User-Generated Content: You retain ownership of any content you create or upload to Great Awareness. However, by uploading content, you grant Magna Conscius a worldwide, royalty-free, perpetual license to use, reproduce, modify, and distribute your content for the purpose of operating, improving, and promoting Great Awareness. You represent that you own or have the right to share all content you upload.
4. Permitted Use and Prohibited Conduct
You agree to use Great Awareness lawfully and responsibly. You shall not: (a) engage in illegal, fraudulent, or harmful conduct; (b) harass, abuse, threaten, or defame other users; (c) impersonate any person or entity; (d) post spam, malware, or unlawful content; (e) attempt to gain unauthorized access to our systems; (f) circumvent security measures or restrictions; (g) use automated tools to scrape or harvest data; (h) engage in any form of abuse, harassment, or discrimination based on protected characteristics.
Violations of this section may result in immediate suspension or permanent termination of your account at our sole discretion, without refund of any fees.
5. Aristonos AI: Special Terms and Limitations
Aristonos AI is an intelligent personal assistant provided for wellness support, lifestyle coaching, and behavioral insights. Aristonos is not a medical professional, doctor, or therapist. Aristonos does not diagnose, treat, cure, or prevent any medical condition or mental health disorder.
Accuracy and Limitations: While we strive to provide accurate and helpful information, Aristonos AI may make mistakes, provide inaccurate recommendations, or misunderstand your inputs. You acknowledge that Aristonos is an AI tool and may have limitations in understanding complex health situations. You should not rely solely on Aristonos for critical wellness decisions.
Medical Emergencies: If you are experiencing a mental health crisis, suicidal thoughts, or medical emergency, you must contact local emergency services immediately (in Kenya: 999 for police, 112 for ambulance, or local mental health crisis hotlines). Great Awareness and Aristonos cannot provide emergency care.
No Warranty of Results: Aristonos provides recommendations based on behavioral science and psychology, but we do not guarantee any specific results or outcomes. Your actual wellness results depend on your actions, circumstances, and professional care you receive elsewhere.
Consent to Use: You must affirmatively opt-in to use Aristonos AI features. Your conversations are stored and analyzed to personalize recommendations. You can disable Aristonos or delete conversation history at any time.
6. Subscriptions, Payments, and Refunds
Great Awareness offers both free and paid subscription tiers. Paid subscriptions are billed through M-Pesa and charged to your registered mobile number. By initiating a subscription, you authorize Magna Conscius and M-Pesa/Safaricom to charge your account on a recurring basis (daily, weekly, monthly, or annually as selected).
Subscription Cancellation: You may cancel your subscription at any time through the app settings or by contacting support. Cancellation takes effect at the end of your current billing period. No refunds are issued for partial months or weeks of service already paid.
Refund Policy: We offer a 7-day full refund for new subscriptions if you are dissatisfied, provided you request the refund within 7 days of the initial charge. After 7 days, subscription fees are non-refundable. Refunds are processed back to the M-Pesa account used for purchase. M-Pesa transaction fees are non-refundable.
Price Changes: We reserve the right to change subscription prices at any time. Price changes apply only to new subscriptions and renewals. Existing subscribers will be notified 30 days before any price increase. Continued use after a price increase constitutes acceptance of the new price.
Billing Disputes: Contact support within 30 days of a disputed charge. M-Pesa/Safaricom terms and conditions apply to all payment processing.
7. Third-Party Services and External Links
Great Awareness may integrate with or reference third-party services including Cloudflare (hosting), M-Pesa (payments), and other providers. These third-party services are governed by their own terms and privacy policies. We are not responsible for third-party services, their availability, accuracy, or conduct. Your use of third-party services is at your own risk.

8. Content Moderation and Removal
We reserve the right to monitor, review, remove, or restrict any user-generated content that violates these Terms or applicable law, including content that is abusive, unlawful, defamatory, harassing, or promotes harm. We may remove content without notice if we determine it violates these Terms.
We are not responsible for user-generated content, including accuracy, copyright, or legality. Users remain solely responsible for their own content. We are not liable for removal or non-removal of any content.
9. Health and Wellness Disclaimers
Great Awareness provides wellness education and behavioral support only. It is not a medical service, healthcare provider, hospital, or mental health professional. Great Awareness does not provide medical advice, diagnosis, or treatment. Nothing in Great Awareness should be interpreted as medical advice.
If you have medical or mental health concerns, please consult a qualified healthcare professional. Great Awareness should complement, not replace, professional medical or mental health care. If you are experiencing a mental health crisis or suicidal thoughts, contact emergency services immediately.
Assumptions of Risk: You use Great Awareness at your own risk. Any reliance on wellness recommendations, behavioral coaching, or insights from Aristonos is entirely at your discretion. You assume all risks associated with using Great Awareness for wellness purposes.
10. Warranties Disclaimer
GREAT AWARENESS IS PROVIDED 'AS-IS' AND 'AS AVAILABLE' WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT GREAT AWARENESS WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR HARMFUL CODE.
We do not guarantee the accuracy, completeness, or reliability of any content, recommendations, or information provided. Aristonos AI recommendations are not guaranteed to be accurate or suitable for your specific situation. Use at your own risk.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY KENYAN LAW: (A) MAGNA CONSCIUS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR LOST OPPORTUNITY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. (B) MAGNA CONSCIUS'S TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID FOR GREAT AWARENESS IN THE 12 MONTHS PRECEDING THE CLAIM.
Some jurisdictions do not allow exclusion of certain damages, so this limitation may not apply fully to you. This clause does not limit liability for fraud, willful misconduct, or violations of law.
12. Indemnification
You agree to indemnify, defend, and hold harmless Magna Conscius, its officers, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from: (a) your use of Great Awareness; (b) your violation of these Terms; (c) your user-generated content; (d) your infringement of third-party rights; (e) your conduct on the platform. This indemnification applies even if the claim arises from our alleged negligence or strict liability.
13. Account Termination and Suspension
We may suspend or terminate your account immediately and without notice if: (a) you violate these Terms; (b) we determine your use is unlawful or harmful; (c) you engage in fraud, abuse, or harassment; (d) you breach payment obligations; (e) you attempt to compromise platform security. Upon termination, your right to use Great Awareness ends immediately.
You may terminate your account by contacting support. Upon termination, your data will be deleted according to our Privacy Policy retention periods. Termination does not affect your payment obligations for services already provided.
14. Dispute Resolution and Arbitration
These Terms shall be governed by and construed in accordance with the laws of Kenya, without regard to its conflicts of laws principles. Any dispute, claim, or controversy arising from or relating to these Terms or Great Awareness shall be exclusively resolved in the competent courts of Kenya.
Before initiating formal legal proceedings, we encourage good-faith negotiation. If a dispute cannot be resolved through negotiation within 30 days, either party may pursue legal remedies available under Kenyan law.
15. Entire Agreement and Severability
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Magna Conscius regarding Great Awareness. These Terms supersede all prior agreements, understandings, and representations. If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be severed, and the remaining provisions shall remain in full force and effect.
16. Changes to Terms and Service Availability
We may update these Terms at any time. We will notify you of material changes by posting the updated Terms and updating the 'Last Updated' date. Your continued use of Great Awareness after updates constitutes acceptance of the revised Terms.
We reserve the right to modify, suspend, or discontinue Great Awareness or any feature at any time, with or without notice, for any reason. We are not liable for any suspension or discontinuation of service. We make no guarantee that Great Awareness will be available continuously or indefinitely.
